What is a digital signature, and how is it used to certify a document? A digital signature (also called a digital pass-phrase) is a method of proving the authenticity of what is being signed. A document may be signed with a digital signature, but the certificate, if required, may be produced with other means, such as an autograph or physical signature. The certificate that is signed will not be a copy of that document itself; instead, it will simply be a way for a trusted third party to verify that the signature truly was signed by that person. A digital signature is different from a signature on a paper document. A signature on paper is a statement that has been signed in ink. A digital signature is a series of mathematical formulas that have been converted into a string of characters. (In order to create an authentic digital signature, a private key must be used there is no “secret key” involved.) How does the U.S. government protect confidential information when a digital signature is not used? In practice, the Department of Justice rarely issues a subpoena for business or banking records without first obtaining the signature of a private party to verify that the document is not being forged, or an order to produce financial records. There are, however, exceptions to this. If the electronic data are already available to the public and are contained in a document filed with a Federal agency. Can a trusted third party produce a certificate in electronic form that will allow a government agency to confirm that a digitally signed document is authentic? Not at this time.
